Terms of Service — WritePath Education (United States)
Effective date: 14 October 2026
Which edition applies to you: these are our United States terms — they apply to memberships bought in our US store by families who live in the US. Everyone else is covered by our main Terms of Service: writepatheducation.com/policies/terms-of-service.
These terms are the agreement between you and GISE Australia Pty Ltd, trading as WritePath Education (ABN 70 664 663 049), an Australian company ("WritePath," "we," "us"), for memberships and services purchased or used in our United States store. By creating an account, starting a free trial, or subscribing, you agree to them. Our Privacy Policy and Refund Policy are part of the deal and worth reading — they are short and written in plain English, like this page.
1. Who can agree to these terms
You must be an adult — a parent or legal guardian — to create an account, start a trial, or buy a membership. Children use WritePath only through an account their parent created and manages. You are agreeing to these terms for yourself and on behalf of each child you register, and you are responsible for your children's use of the program.
2. What WritePath is (and isn't)
WritePath is an online English program for students in Grades 5–12: a short module each weekday — reading, writing, vocabulary, grammar, and peer assessment — with personalized feedback on every piece of work, delivered by email to your child and to you. It is a supplement to your child's education, built to grow real skill through daily practice.
What it is not: WritePath is not a school, is not accredited, does not award grades or credit that any institution is bound to recognize, and does not administer any standardized test or predict results on one. Our levels and feedback are our own reading of your child's work against our curriculum's expectations — a useful signal, not a formal assessment. Every child is different, and we do not guarantee any particular academic outcome.
3. Your account
Keep your account credentials safe, keep your email addresses current (they are how feedback and service messages reach your family), and give us accurate information. A membership is for your family: the children registered on your plan. Don't share access beyond them, and don't register children who aren't in your care.
4. Free trial
The first week is free — no credit card, no obligation. A trial ends after its seven days unless you subscribe; nothing is charged unless you choose a paid plan. Trial families get the same program and the same feedback as members. We may decline or end a trial that is being abused (see §8).
5. Memberships, billing, and renewal
- How billing works. Paid memberships are sold through our online store and billed as subscriptions in US dollars by our commerce platform (Shopify and its subscription billing partner). The price, the billing interval (monthly or yearly), and the number of children are the ones you choose at checkout and can see at any time on the pricing page and in My Account.
- Renewal. Memberships renew automatically at the end of each billing period until you cancel. Renewal is charged to your saved payment method at the then-current price of your plan.
- Price changes. If we change the price of your plan, we will email you before the change applies to your renewal, with enough notice to cancel first. A price change never applies mid-period to a period you have already paid for.
- Plan changes. You can add a child, remove a child, or switch between monthly and yearly from My Account. Upgrades take effect promptly; downgrades and removals take effect at your next renewal, and if a downgrade means one of your children comes off the plan, we will ask you which one rather than choose for ourselves.
- Failed payments. If a renewal payment fails, we will let you know and retry; access may pause until it is resolved.
6. Cancelling
Cancel any time from My Account — no phone call, no exit fee, no lock-in. Your membership stays active until the end of the period you have already paid for, and then simply stops. The one exception is a refund under §7: when a refund request goes through, access ends straight away. What happens to your family's data after access ends is set out, with exact timelines, in the Privacy Policy.
7. Refunds
New memberships carry our 30-day money-back guarantee: if WritePath isn't right for your child, ask within 30 days of your first payment and we will refund it in full. You ask with the Request refund button in My Account, which is available for 30 days from your first payment and no longer appears after that. When a refund request goes through, the membership ends and access stops immediately — it does not continue while the refund is processed. The complete terms, including timing and the one-per-family rule, are in the Refund Policy, which is the authoritative wording. That promise is voluntary and sits on top of, not instead of, any rights your state's consumer laws give you.
8. Fair use
The program is for your family's personal, non-commercial educational use. A few things break it for everyone, so they're not allowed:
- sharing account access outside your registered family, or using one child's seat for several children;
- submitting work through automated means, scraping or bulk-downloading content, probing our systems, or interfering with the marking service (we apply rate limits and anti-abuse checks, and we may throttle or block traffic that trips them);
- submitting content that is unlawful, or that harasses, threatens, or targets any person — the submission box is for schoolwork;
- misrepresenting who you are, registering with someone else's email address, or entering email addresses you don't control;
- reselling, republishing, or redistributing our curriculum, modules, marking keys, or feedback.
We may suspend or end an account that materially breaches these terms (§13).
9. Your child's work, and our content
Your child's writing belongs to your child. By submitting work, you give us the limited permission we need to operate the program: to process the work to mark it and produce feedback, and to handle it exactly as the Privacy Policy describes — which for most work means we do not keep it once your feedback email is delivered.
Our content belongs to us. The curriculum, modules, texts we author, marking keys, feedback, reports, site design, and the WritePath name are our intellectual property (or our licensors'). Your family may use them for your own learning while you have access; you may not copy them for redistribution, use them to build a competing service, or use them to train AI systems.
10. Marking, feedback, and honesty about it
Marking is performed with the help of an AI model working against teacher-authored marking keys and criteria — the model applies our teachers' standards. It is accurate and specific by design, and like any marker, human or machine, it will not be perfect every time. Feedback is educational guidance for your family, not a certified assessment, and the program's signals about how a piece was produced (such as an AI-authorship estimate) are context for parents — estimates, never accusations, and never used to punish a student. If something in your child's feedback looks wrong, write to us and a person will look at it and put it right for the work ahead. Because we do not retain most submitted writing (see the Privacy Policy), the feedback email is the family's record of each piece.
11. Tutor links and the Educator Partner Program
If you choose to connect a tutor or educator to your child through WritePath, that link is created by you, accepted by them, visible on your account, and endable by either of you at any time; what the educator can see is set out in the Privacy Policy. Educators participating in our Educator Partner Program are bound by their own program terms, which are separate from these. Memberships paid for by a tutor or school run on the sponsoring arrangement's terms, including for refunds.
12. The service will evolve
We improve the program continuously — modules are updated, features added, content revised. We aim to keep WritePath available every day and to fix problems quickly, but we do not promise uninterrupted availability, and short maintenance windows happen. If we ever decide to retire the service or a paid part of it, we will give you notice and refund the unused remainder of anything you have prepaid.
13. If we end an account
We may suspend or terminate an account that materially breaches these terms (including §8), after telling you what the problem is unless the abuse makes that impractical. If we terminate your account without cause, we will refund the unused remainder of your paid period. Data handling after termination follows the Privacy Policy's published timelines in every case.
14. Disclaimers
To the fullest extent your law allows: the service is provided "as is" and "as available," and we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in this section takes away warranties or guarantees that the law of your state does not allow us to disclaim — those stand.
15. Limits on liability
To the fullest extent your law allows, our total liability to you for all claims arising out of the service in any 12-month period is capped at the amount you paid us in that period, and neither of us is liable to the other for indirect, incidental, or consequential losses. These limits do not apply to anything the law does not allow to be limited — including liability for fraud, or for death or personal injury caused by negligence — and they do not limit the non-waivable consumer rights described in §16.
16. Governing law, your local rights, and disputes
These terms are governed by the law of New South Wales, Australia — we are an Australian company, and one body of law lets us keep our promises consistent for every family. But this clause takes nothing away from you: if you live in the United States, you keep every consumer protection of your state of residence that its law does not allow to be waived, and you may bring a claim under those protections in the courts (including small-claims court) where you live. Nothing in these terms requires arbitration, and nothing here limits either party's right to go to court.
If something goes wrong, please talk to us first: hello@writepatheducation.com reaches a person, and almost everything is fixable in one email.
17. Changes to these terms
If we change these terms in a way that matters, we will email the parent address on every active account before the change takes effect. Continuing to use WritePath after the effective date means the new terms apply; if you don't agree with a change, cancel before it takes effect and it never applies to you. The version in force at each renewal governs that period.
18. The paperwork clauses
These terms, the Privacy Policy, and the Refund Policy are the whole agreement between us about the service. If any part of these terms is found unenforceable, the rest still stands. If we don't enforce a term on one occasion, we haven't waived it. You may not transfer your membership to someone else without asking us; we may transfer this agreement to a successor of our business (with your protections intact, as the Privacy Policy also promises).
