WritePath Education — Educator Partner Program Terms

1. These terms and how you accept them
1.1 These terms govern the Educator Partner Program (the "Program") — a free professional toolkit we provide to tutors and teachers whose students use WritePath.
1.2 You accept these terms by ticking the acceptance box and registering as an Educator Partner. If you do not agree, do not register.
1.3 These terms are an agreement between you (personally, or the business entity you register) and WritePath. They do not create employment, partnership, joint venture or agency. You have no authority to bind WritePath or make promises on its behalf.
2. Definitions
- Educator Partner (you) — a person or business registered in the Program and issued an Educator ID.
- Educator ID — your identifier in the format WPE-E-XXXXX.
- Consent Link — an active parent-authorised link between a student and your Educator ID, created and revocable by the parent as described in clause 7.
- Linked Student — a student with an active Consent Link to you.
- Educator Content — reports, Teaching Priorities, Learning Content lessons, feedback views, emails and any other material made available to you through the Program.
- Student Data — any information about a student, family or their work that you can see or receive through the Program.
3. The Program
3.1 While you have an active registration, WritePath provides you, for each of your Linked Students: per-student Activity Summary Reports, AI-generated Teaching Priorities, Learning Content lesson sets, Detailed Feedback views, and one-click lesson delivery to families.
3.2 The Program is a professional toolkit, not a managed service. We do not supervise your tutoring, and you remain solely responsible for your own services, conduct, qualifications, insurances and legal compliance (including any working-with-children requirements applying to your work).
3.3 The Program is non-exclusive. You may work with other providers, and WritePath may work with other educators.
3.4 Who the Program is for. The Program is built for people who tutor or teach other families' children. You are welcome to link your own child or another child in your household so you can use the tools with them.
3.5 We do not vet educators, and we say so to families. WritePath does not interview, screen, background-check, credential-check or otherwise vet Educator Partners. "Educator Partner" means only that a person has registered and accepted these terms. We also do not match, introduce, recommend or refer families to educators, and we publish no directory or list of educators — every relationship in the Program begins with a family who already knows you and chooses to link. You must not represent, or allow a family to believe, that WritePath has checked, approved, endorsed or recommended you. Nothing in the Program makes us responsible for your conduct, your services or your advice.
4. The Program is free, and provided at our discretion
4.1 We provide the Program at no charge. You pay us nothing for it, and we pay you nothing for using it or for anything you do in connection with it. There is no fee, no subscription, no student-number test, no threshold, no commission, no revenue share and no bonus — for anyone, at any number of students, including none.
4.2 We may change, suspend or withdraw the Program — for everyone, or for you alone — at any time, at our discretion, and without giving reasons. That includes deactivating your Educator ID and your access, and ending your Consent Links.
4.3 Where we end your access we will tell you at your registered email address. We will tell linked families only that your participation in the Program has ended and that they may link another educator at any time; we will not give them reasons either.
4.4 Because the Program is provided free of charge, no refund or compensation is payable in any circumstance. Nothing in this clause limits any rights you have that cannot be excluded under the Australian Consumer Law.
5. Your obligations
5.1 Provide accurate registration details and keep them current.
5.2 Keep your login and access token secure. You must not share your educator access with anyone else. You are responsible for activity under your account.
5.3 Use the Program only for tutoring your Linked Students. Acceptable use excludes: accessing or attempting to access data of students who are not your Linked Students; automated scraping or bulk extraction; probing, disrupting or reverse-engineering any part of the platform; and any unlawful, misleading or harmful conduct.
5.4 Act consistently with child-safety expectations at all times. We may end your access immediately under clause 4 or clause 13 if we reasonably believe a safety issue exists.
6. Student Data and confidentiality
6.1 Student Data is confidential family information entrusted to WritePath by parents. You receive it under a limited licence: use it only to plan and deliver tutoring to the Linked Student it relates to.
6.2 You must not: republish, sell, share or disclose Student Data to anyone other than that student's family; use it for marketing; use it to train any AI or machine-learning model; retain systematic copies beyond what tutoring reasonably requires; or remove or obscure the confidentiality watermark on educator pages.
6.3 When a Consent Link ends (for any reason), your access to that student's data ends. You must stop using Student Data for that student and delete copies of Student Data and Educator Content you have taken out of the Program (downloads, exports, screenshots, forwarded reports). Records you created yourself — your own session notes, your own assessments, your invoices to the family — remain yours.
6.4 If you become aware of any unauthorised access to or disclosure of Student Data, notify us at hello@writepatheducation.com within 24 hours.
6.5 You must comply with applicable privacy law in your handling of Student Data. If you hold your own client records about the family, you are their custodian — WritePath is not responsible for your records, and you are not responsible for ours.
7. Consent Links
7.1 Parents create Consent Links (by entering your Educator ID) and may end them at any time. You may accept or decline link requests, and you may end a link.
7.2 Data capture for a Linked Student starts when the link becomes active. Work submitted before the link existed appears in summary form only. Tutor-visible reporting covers the current and previous calendar month.
7.3 WritePath may end or suspend any Consent Link where a parent requests it, a membership ends, or we consider it necessary. We make no promise that any link, student or family will continue.
8. Discount codes
8.1 From time to time we issue you a set of single-use discount codes for the Daily Success yearly plan (25% off — the largest discount we currently offer — one per customer account, not combinable with other offers, valid for six months from issue and expiring automatically). The codes are yours to pass on to families.
8.2 The codes are a marketing courtesy. They have no cash value, are not exchangeable for money or credit, and no payment of any kind attaches to their issue or their use — you earn nothing when a code is redeemed.
8.3 We may vary, replace or withdraw the codes, or the code program itself, at any time under clause 4.
9. Use of the Program, audit and misuse
9.1 We may check that the Program is being used as these terms intend, using our own records and publicly available information.
9.2 Where we find misuse — including breach of clause 5.3, misuse of Student Data, or access obtained or held on inaccurate information — we may act under clause 4 or clause 13.
10. Intellectual property
10.1 To the extent intellectual property rights subsist in them, WritePath owns the rights in the platform, the Program and Educator Content, and nothing transfers to you. We do not claim ownership of a student's own work: a student's writing and answers belong to the student and their family, and we use them under the permissions in our customer terms. Where AI-generated material may not attract copyright at all, this clause claims only what can be claimed — and your licence in 10.2 and your obligations in clause 6 apply to Educator Content either way.
10.2 You have a limited, revocable, non-transferable licence to use Educator Content solely to tutor the Linked Student it was generated for, and to share it with that student's family through the Program's own delivery tools.
10.3 You may describe yourself as a "WritePath Educator Partner" while registered, in accurate and non-misleading ways. You must not register domains, handles or business names confusingly similar to WritePath's, or imply you are WritePath itself.
11. Client relationships — mutual non-circumvention
11.1 We stay out of your client list: WritePath will not use Student Data to solicit any family with a Consent Link to you to leave you or to switch to another tutor or a WritePath-delivered tutoring service.
11.2 You stay out of ours: you will not use the Program or Student Data to divert linked families away from their WritePath memberships.
11.3 Nothing stops a family independently choosing any provider — this clause binds our respective conduct, not families' choices.
11.4 What 11.1 does not cover. It does not restrict: our general advertising, newsletters, product announcements or marketing to our customer base as a whole; responding to a family who approaches us first; anything we must do for safety, security, legal or regulatory reasons; or sending notices we are required or entitled to send. It applies while your registration is active and for 12 months afterwards, and then ends.
12. Changes to these terms
12.1 We may change these terms as the Program evolves. Changes take effect when published, with the version noted on the terms page.
12.2 For a change that is materially adverse to you, we will give at least 30 days' notice by email before it takes effect.
12.3 If you do not accept a change, stop using the Program and deregister before it takes effect. Continued use after the effective date is acceptance.
13. Ending your participation
13.1 You may deregister at any time by written notice (email suffices).
13.2 We may end or suspend your participation at any time under clause 4, without giving reasons. Separately, and so that you know what we treat as serious, we will act immediately where we reasonably believe: a child-safety risk exists; Student Data has been misused or a confidentiality breach has occurred; there has been fraud or unlawful conduct; or there has been a serious or repeated breach of these terms.
13.3 Effect of ending (either way): your access and licences end and Consent Links close. Clauses 6 (Student Data), 10, 11, 14 and 16 survive.
14. Liability and indemnity
14.1 Nothing in these terms excludes rights that cannot be excluded, including under the Australian Consumer Law. Where a guarantee cannot be excluded but liability can be limited, our liability is limited (at our option) to resupplying the relevant services or paying the cost of resupply.
14.2 Subject to 14.1: neither party is liable to the other for indirect or consequential loss, loss of profit, revenue, goodwill or data; and each party's total aggregate liability under these terms in any 12-month period is capped at $500.
14.3 You are solely responsible for your tutoring services and advice; we are solely responsible for operating the platform. Educator Content is an aid to your professional judgement, not a substitute for it (see clause 15.2).
14.4 What the cap does not cover. The cap in 14.2 does not apply to: your breach of clause 6 (Student Data and confidentiality); your infringement of our intellectual property (clause 10); amounts payable under the indemnity in 14.5; or either party's fraud or wilful misconduct.
14.5 Your indemnity. You indemnify us against loss, damage, third-party claims, regulatory fines and reasonable legal costs we incur to the extent caused by: (a) your breach of clause 6 (Student Data and confidentiality) or clause 5.3 (acceptable use); (b) a claim by a family, student or other person arising out of your own tutoring services, advice or conduct — including any child-safety failure and any allegation of harm to a student; or (c) your breach of law in connection with the Program. This indemnity is reduced proportionately to the extent our own act or omission caused the loss, does not extend to indirect or consequential loss, and is subject to your being given notice of the claim and a reasonable opportunity to participate in its handling.
15. No guarantees
15.1 We do not guarantee any level of student numbers, any referrals, or the continuity of any family relationship. We make no promise that the Program will continue to be offered (clause 4).
15.2 Reports, Teaching Priorities and lessons are generated with AI from the student's own work and may contain errors. You must review them before relying on them in a session. We do not guarantee uninterrupted availability, and planned changes or maintenance may pause features.
16. Disputes and governing law
16.1 Before starting any proceedings, the parties will try to resolve a dispute in good faith: written notice of the dispute → responsible people discuss within 14 days → if unresolved after a further 14 days, mediation (Resolution Institute rules, in Canberra or by video) before litigation, except for urgent injunctive relief.
16.2 These terms are governed by the laws of the Australian Capital Territory, Australia, and the parties submit to the non-exclusive jurisdiction of its courts.
17. General
17.1 Notices — to us: hello@writepatheducation.com. To you: your registered email. Notices are taken received one business day after sending.
17.2 Assignment — you may not assign without our consent; we may assign to a related entity or on a business sale with notice to you.
17.3 Severance — an unenforceable provision is severed; the rest survives.
17.4 Entire agreement — these terms and your registration form are the whole agreement about the Program and replace prior discussions.
